Upon receipt of a complete and valid DMCA notice, QYRONY will expeditiously remove or disable access to the allegedly infringing material and notify the affected Vendor or User.

3. Submitting a DMCA Counter-Notice

If you are a Vendor or User who believes that your material was removed or access was disabled as a result of a mistake or misidentification, you may submit a written Counter-Notice to our Designated Agent containing the following information (17 U.S.C. § 512(g)(3)):

  1. Your Signature: A physical or electronic signature of the user.
  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed.
  3. Perjury Statement: A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. If a valid counter-notification is received by our Designated Agent, QYRONY will forward a copy of the counter-notice to the original complaining party. Unless the copyright owner files an action seeking a court order within 10 to 14 business days, QYRONY may restore the removed material.

4. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), QYRONY enforces a strict Repeat Infringer Policy. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to legal liability for damages, including court costs and attorneys’ fees incurred by QYRONY or the alleged infringer.
